Federal law in the United States states that an electric bicycle must have a top speed under 20 mph and a motor which produces less than 750 watts/1 hp. They are not considered motor vehicles by the federal government and are subject to the same consumer safety laws as unassisted bicycles. Their legality on public roads is under state jurisdiction, and varies. See the main Electric bicycle laws article for details on the law in individual states.
However, each country is free to allow faster s-pedelecs if they go through collective or individual type approval. Typically, an S-Pedelec can be associated with "mofas" or "mopeds" or "light scooters". Germany has such a solution: S-pedelecs have max. 500W motors, max 45km/h, max 300% support, can drive up to 20Km/h without pedalling, plus other constraints regarding security, and are associated with Mopeds. In the City you can't use bicycles paths, but you can in the country side.
Parliament has decided to approve the speed pedelec – a type of super electric bike that can reach speeds of up to 45 km/hour – for riding on cycle paths. Danish Parliament has decided that as of July 1 2018 those operating the super bikes only need to have turned 15 and wear a helmet, while the licence and number-plate demands will no longer be in play. 
There are dozens of good 25Km/h pedelecs. Our advice is to go the nearest good e-bike store and get it from there, because e-bikes may need good support. Only if you like servicing a bike yourself is buying from the Internet a good option. As of Spring 2013, a good benchmark to compare with is the Austrian KTM Amparo also called KTM Severo 8M or the German Kalkhoff Impuls or Agattu series. It has a reliable Panasonic middle motor and a good battery. If you want a more sexy design, try the SMART from the urban car maker of the same name.
Rad Power’s lineup of 2019 bikes start at $1,699 (there’s also a Cyber Monday special on their 2018 models), proving that electric bikes don’t have to be over $2,000 to have the amenities and quality you need for daily commuting. Of course, that’s still a steep price for some. But as prices keep dropping in the e-bike industry, affordability breeds better access, and this might be the key that our cities—and their traffic—so desperately need.
My homeowners (State Farm) covers bikes , but assumes $500 per bike. They will add the bikes as personal property, but the premium is excessive (about $300/year per bike, and we have four bikes). I did increase our personal umbrella liability coverage, and it covers us if family members any sort of accident on our e-bikes that injures us or others or others' property, though only covers $500 each for our own bikes (under the homeowners coverage). It was not very expensive to increase the umbrella policy (as it resulted also in a reduced rate on our car insurance).
Even with cheaper or heavier bikes, once you accept that you are really meant to pedal gently and let the motor do the work, non-speed freaks will get into it. E-bikes are great for commuting and for places that aren't pancake flat. They'll pull you away from the lights quickly, iron out hills and stop you getting sweaty, so you can bin the Lycra and ride in jeans, a suit, or a winter coat.
I called Geico earlier today. They could insure me with Renters Insurance, but … I would need to have a Renter's Policy first, before the secondary insurance company they deal would insure my two bikes (Surly Long Haul Trucker and Yuba Sweet Curry custom eBike). BUT … unfortunately …. The company that would insure my bicycles will NOT insure me because we have a Pitbull !!! Can you believe that … !!!
The pedals on a motorised bicycle must be the primary source of power for the vehicle. If the motor is the primary source of power then the device cannot be classed as a motorised bicycle. For example, a device where the rider can twist a throttle and complete a journey using motor power only without using the pedals, would not be classed as a motorised bicycle.
European Union directive 2002/24/EC exempts vehicles with the following definition from type approval: "Cycles with pedal assistance which are equipped with an auxiliary electric motor having a maximum continuous rated power of 0.25 kW, of which the output is progressively reduced and finally cut off as the vehicle reaches a speed of 25km/h (15.5mph) or if the cyclist stops pedaling." This is the de facto definition of an electrically assisted pedal cycle in the EU. Government regulation is written and administered with a broad, dull, painful axe. Regulations do not mix well with independent, maverick, DIY programs either. Vehicle regulations get started when there is either a visible tragedy, or a rising conflict with the status quo (like the SFO scooters program). The ebike community cannot afford a deadly accident especially if it involves others and the ebike or ebike rider are at fault. The Ebike community is up against a tough status quo that consists of pedestrians, motor vehicle traffic, the large well-funded and battle tested regular bicycle community, and the environment (especially for MTB riding and off-road use).
This article did a good job of trying to justify the assist speed limits but fell short of detailing how that can ever be effectively enforced. In reality the only enforcement that is going to work is applied speed limits to use of bikes and ebikes. For example, it makes sense that a bike lane on a street that the speed limit of vehicles is the speed limit of the bikes/ebikes. On sidewalks and shared pedestrian paths the speed limit probably does need to be in the 15-20mph range to match traditional bikes speeds on those paths.
Federal law defines the limits of a low speed electric bike, equating it to a bicycle, and bypassing the definition of a motor vehicle only “For purposes of motor vehicle safety standards…” which means that the manufacturers of these bicycles don’t have to meet federal equipment requirements, and are instead governed by the manufacturing requirements of the Consumer Product Safety Act. There is no mention of exemption from other federal, state, and local traffic laws, or exemption from the definition of a motor vehicle for other purposes.3 This means the law applies to the manufacturer’s product and sale, avoiding federal safety requirements applying to a motor vehicle such as brake lights, turn signals and braking specifications. The goal of the law was to give businesses a legal framework to define and sell low speed electric bikes without the more stringent Federal classification of a motor vehicle. Ebikes that meet the criteria are considered a “bicycle”, do not meet the definition of a motor vehicle, and will be regulated by the Consumer Product Safety Commission. The law also grants the commission authority to add safety requirements to this product. The Federal law supersedes all state laws that equate bicycles to ebikes where the state law is more stringent (lower limits) on power and speed.
The federal Consumer Product Safety Act defines a "low speed electric bicycle" as a two or three wheeled vehicle with fully operable pedals, a top speed when powered solely by the motor under 20 mph (32 km/h) and an electric motor that produces less than 750 W (1.01 hp). The Act authorizes the Consumer Product Safety Commission to protect people who ride low-speed electric vehicles by issuing necessary safety regulations. The rules for e-bikes on public roads, sidewalks, and pathways are under state jurisdiction, and vary.
An electric bicycle also known as an e-bike is a bicycle with an integrated electric motor which can be used for propulsion. Many kinds of e-bikes are available worldwide, from e-bikes that only have a small motor to assist the rider's pedal-power (i.e., (pedelecs) to somewhat more powerful e-bikes which tend closer to moped-style functionality: all, however, retain the ability to be pedalled by the rider and are therefore not electric motorcycles.
In conformance with legislation adopted by the U.S. Congress defining this category of electric-power bicycle (15 U.S.C. 2085(b)), CPSC rules stipulate that low speed electric bicycles (to include two- and three-wheel vehicles) are exempt from classification as motor vehicles providing they have fully operable pedals, an electric motor of less than 750W (1 hp), and a top motor-powered speed of less than 20 miles per hour (32 km/h) when operated by a rider weighing 170 pounds. An electric bike remaining within these specifications is subject to the CPSC consumer product regulations for a bicycle. Commercially manufactured e-bikes exceeding these power and speed limits are regulated by the federal DOT and NHTSA as motor vehicles, and must meet additional safety requirements. The legislation enacting this amendment to the CPSC is also known as HR 727. The text of HR 727 includes the statement: "This section shall supersede any State law or requirement with respect to low-speed electric bicycles to the extent that such State law or requirement is more stringent than the Federal law or requirements." (Note that this refers to consumer product regulations enacted under the Consumer Product Safety Act. Preemption of more stringent state consumer product regulations does not limit State authority to regulate the use of electric bicycles, or bicycles in general, under state vehicle codes.)
Several bills have been sponsored to legalize electric bicycles for use on NYS roads, and several have overwhelmingly passed at the committee level, but none of these initiatives has been able to be heard and then passed in the New York State Senate, until 2015. The latest bill S3997, "An act to amend the vehicle and traffic law, in relation to the definition of electric assisted bicycle. Clarifying the vehicle and traffic law to define electric assisted bicycles; establish that electric assisted bicycles, as defined, are bicycles, not motor vehicles; and establish safety and operational criteria for their use." has passed in the Senate for the first time ever in 2015. The related Assembly bill A233 was not brought to a vote in the assembly even though it had passed with little issue in prior years.
If you are a person who enjoys riding a bike casually at a typical bike path speed (10-15mph), and you like the idea of an ebike push up a hill, against the wind or to relieving a sore knee, then your market for a fully legally defined ebike is very broad and your practical use only has a few limitations. Most ebikes will meet your needs and expectation. I would estimate that 85% of the electric bikes on the market are 100% compliant meeting the federal definition. I encourage you to take the plunge and get a good quality ebike and ride more with assist. Do so with the confidence that electric bikes are here to stay.
